LEASE AGREEMENT

Terms of your Vacation Rental Agreement
This is a Vacation Rental Agreement.  The rights and obligations of the parties to this agreement are defined by law and include unique provisions permitting the disbursement of rent and expedited eviction of tenants.  Your agreement, payment of money or taking possession of the property after receipt of the agreement, is evidence of your acceptance of the agreement and your intent to use this property for a vacation rental.

Reservation and Payment
Upon booking your reservation, the first payment is due.  The full balance must be received within 30 days of your check-in date. Check-in/Check-Out dates are set forth in Confirmation provisions. Check-in is 4:00pm. You will receive your access code to enter the property prior to your arrival. Check-out is 11:00am.  Late check-out will result in an additional fee of 200% per day of the daily rental fee.

Cancellation Fees
Camelback Real Estate does not offer any cancellation fees.  We offer Travel Insurance. 

Occupancy/Minimum Acceptable Age/Family Groups
Each property lists its occupancy limits.  Advertised occupancy limits must be adhered to.  It is the policy of Camelback Real Estate to enforce a minimum age and to rent to family groups only due to our obligations to the rental property Owners.  Tenants must be 25 years of age to enter into a Vacation Rental Agreement.  A family group is defined as parents, grandparents, children and extended family members vacationing in one home.  A non-family group is defined as un-chaperoned non-family group, fraternities, school or civic groups.  (We rent homes without respect to race, religion, color, sex, national origin, handicap, familial statues, sexual orientation or gender identity of any tenant). 

Care/Damage/Accidents to rental property
Damage Insurance is offered with your reservation. Tenant assumes responsibility for anyone staying with/or invited by the Tenant.  Tenant must report any damage that may result during the Tenant’s stay “Immediately” which means within 24 hours of the loss or damage and, in all cases, prior to check out.  Camelback Real Estate, in Its sole discretion, will determine the extent of repairs necessary to correct any damage caused by Tenant.  If the Damage is covered under the Damage Insurance, a claim will be filed.  If the damage is not covered by the Damage Insurance, any costs associated with repairs resulting from damage caused by Tenant will be the sole financial obligation of the Tenant and any such costs will be charged to the credit card on file.   Tenant shall take care of the Unit, its appliances, furnishings and maintain the Unit in a neat and sanitary Condition. Tenant will leave the Unit in the same condition as at check-in, including furniture placement. Tenant shall not use the Premises for any disorderly or unlawful purposes or in any manner offensive to others or in any manner which would constitute breach of the lease.  Tenant shall comply with all laws, rules and regulations applicable to the Premises, including those of applicable homeowner associations.  

Parking
Only 2 cars per Unit.  There is an overflow parking area available for additional cars.  Fines will be imposed for more than 2 cars at the Unit. No ATV’s, RV’s, Trailers, Snowmobiles, Mini-bikes, boats motorcycles or commercial vehicles of any kind are permitted.  Park in designated areas only.  Do not block steps or park along roads.  The speed limit is 20 mph.  Use extra caution during snow icy or rainy conditions.

Furnishings and Cleaning
Each property is equipped with basic housekeeping items such as, kitchen appliances, dishes, Cookware, silverware, glassware, bed pillows, bed linens and towels.  Each property is privately owned and reflects the tastes and needs of the Owners.  Tenants are expected to use the property as if it were their own. Left undamaged, clean and with all trash removed and taken to the designated dumpster. Furnishings of the Unit are subject to change without notice.  Furniture, bedding, utensils or any other property supplied with the Premises must not be taken out or transferred from one property to another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest.  Moving of furnishings, inside or outside of the Premises, is strictly forbidden.  If any furnishings need to be moved back to original placement, there is a $125.00 per hour (minimum charge of half hour) charged to the Guest.  A basic supply of linens is provided in each property.  Bed linen and bath towels are not changed during your stay.  The startup kit of hand soap, toilet tissue, paper towels, laundry soap, dish soap and trash bags are not replenished.  Guest is responsible for replenishing their own toiletries and paper products. 

Comparable Premises and Force of Nature
Unforeseeable circumstances may arise, which make it impossible or impractical for Camelback Real Estate to provide the anticipated accommodations to Guest. Such circumstances may include, but are not limited to, scheduling problems,Equipment failure, road/building construction that may occur at, around, or near any of our Properties, as well as fire or other casualty at the Premises.  In such a circumstance, Camelback Real Estate reserves the right to transfer Guest to another vacation property of reasonably Comparable value, determined in the sole discretion of Camelback Real Estate, whose determination shall be final.  

No Pets 
Tenant agrees to no pets inside or outside the property.  If pets are found to be brought on the property by the Tenant, fines and immediate eviction will be imposed.  

No Smoking/No Fireworks/No Firearms/No Charcoal Grills
All Rental homes are non-smoking.  No fireworks or firearms are allowed.  Each unit has a gas grill, no charcoal is allowed.  No open flame. Use of such will result in fines/and or immediate eviction.  

Repairs
Tenant agrees that Agent is authorized to enter the property during the term of Tenant’s Occupancy. Agent will give 24 hour notice, except in the event of an emergency, to make repairs or to enforce the Rules and Regulations of the Development and or upon any breach of this Agreement. No refund shall be given for breakdown of appliances, heating, cooling or other equipment.  Repairs will be made as soon as possible. Camelback Real Estate agrees to provide maintenance and repairs, as required.

Lost and Found
Items left by tenant on the property after check-out are not Agent’s responsibly.  If items are discovered, they will be returned to the Tenant if Tenant notifies Agent of missing items within thirty (30) days of the check-out.  Camelback Real Estate will mail the item(s) COD, tenant must pay a handing fee of $25 (plus tax), plus shipping and handling.  Any items not claimed with 30 days after check-out will be donated to a local charity.

Indemnification
Tenant hereby agrees to indemnify and hold Camelback Real Estate harmless for injuries or other Losses to Tenant and other persons and property that may occur in connection with Tenants use of The Premises.  Tenant further agrees that, as agent for the owner of the Premises, Camelback Real Estate has no control over the condition of the Premises, and furthermore, that Camelback Real Estate is not under any obligation to accept for safekeeping any monies, securities, jewelry, or other articles of personal property belonging to the Tenant, nor is Camelback Real Estate liable for any loss in connection with any such items, or for providing security for the Premises.  Camelback Real Estate will cooperate in forwarding any complaint or concern of the tenant to the owner of the Premises, but shall not be obligated to correct any condition or hazard associated with the Premises.  All property information is provided by the individual property owner and is true and accurate to the best of Camelback Real Estate’s knowledge; however, Tenant agrees to indemnify and hold Camelback Real Estate harmless for any property information errors or changes due to maintenance or owner’s removal of items from the home.  We have made every effort to ensure that all Information contained in the camelbackresortrentals.com website is correct and accurate. 

Attorney’s Fees and Costs
In the event that any action is required by Camelback Real Estate to enforce this Agreement, Camelback Real Estate shall be entitled to recover its damages and expenses including Reasonable attorney’s fees.

Consumer Notice
Camelback Real Estate hereby states that with respect to this rental property, Camelback Real Estate is acting the following capacity; Agent of the Owner/Landlord pursuant To the property management or Exclusive leasing Agreement. This Contract contains the entire Agreement between the parties.  This Contract/Agreement shall be governed by Pennsylvania law with any disputes to be resolved solely in the courts of Monroe County, Pennsylvania.  This Agreement shall be binding upon the heirs, successors and assigns of the parties.
